Conformity of Submitted Documents
For us to prepare a file that complies with the requirements, we need documents that are “legible” and “complete.”
Please read the following instructions before submitting documents to us:
- You may scan your document using a scanner or take a photograph of it. If you take a photograph, place the document flat on a table and ensure that your device is positioned at an appropriate angle so that all text is clearly visible.
- Please ensure that the scan or image quality is sufficient for the entire document to be read clearly.
- Please ensure that each page is fully visible. If any pages are missing, or if the top, bottom, or side of a page is cut off, the document will be considered incomplete.
Estate Documents
You may submit any estate documents that you already have. If additional documents are required, a member of our team will contact you.
The following documents are required in all estate files:
– An official Proof of Death;
– Will search certificate issued by the Chambre des notaires du Québec;
– Will search certificate issued by the Barreau du Québec.
The following documents may also be required, as applicable:
– Complete will (notarized, witnessed or holograph);
How can I tell whether my notarized will is a certified copy?
A notarized document will be considered incomplete if it is not certified as a “certified copy.”
To be recognized as a certified copy, a copy of a notarized document must bear the notary’s seal on the first page. It must also include the words “certified true copy” on the last page. In addition, the notary must have signed beneath that certification statement.
If the notarized document was obtained from the courthouse, the document must bear a “certified true copy” stamp together with the clerk’s signature.
– Codicil or testamentary modification (notarized, witnessed or holograph);
– Judgment of probate or minutes of probate by notary (for witnessed or holograph wills);
When must I provide proof that a will has been probated?
A will or codicil that is holograph or made in the presence of witnesses will be considered incomplete if proof of probate has not been provided.
A will or codicil may be prepared in one of three forms:
- entirely handwritten (holograph);
- made in the presence of witnesses;
- notarized.
When a will is holograph or made in the presence of witnesses, the law requires that it be probated before it can be relied upon. This is a mandatory legal procedure.
Even if, for any reason whatsoever, the will was not probated at the time of death, this step remains necessary for us to prepare your claim file.
A will may be probated by a notary in your area. The notary will be able to explain the procedure and the associated costs.
We require the final document confirming that the probate process has been completed, namely the judgment of probate or the notarial minutes of probate, which is issued at the conclusion of the process.
– Marriage contract;
– Declaration of heirship;
– Deed of appointment of liquidator;
– Birth certificate.

Under an agreement with the RAMQ and the MSSS, Proactio received a list of individuals who were diagnosed with a compensable disease during the period covered by the class action, together with the date of that diagnosis.
- If a Tobacco-Victim appears on this list, no additional proof of diagnosis is required.
- If a Tobacco-Victim does not appear on this list, or if the recorded diagnosis date is not prior to March 12, 2012, proof of diagnosis is required.
Proactio does not obtain this proof on your behalf.
A form has been prepared in collaboration with Santé Québec to facilitate requests for proof of diagnosis from healthcare institutions. This arrangement with Santé Québec allows medical archivists to send medical records related to the class action directly to Proactio.
If you have received a communication from us indicating that we were unable to locate the Tobacco-Victim’s diagnosis, this means that you must obtain proof of diagnosis using the form below.
