Before proceeding to the registration form, it is essential that you understand the eligibility criteria and validation process.

Eligibility criteria for the CQTS-Blais tobacco class action

For the estate to be eligible for compensation under the tobacco class action, the tobacco victim must:

  1. Have died after November 20, 1998.
  2. Have been diagnosed with one of the following diseases before March 12, 2012:
    • Primary lung cancer;
    • Primary squamous cell cancer of the larynx, oropharynx or hypopharynx (throat cancer”);
    • Emphysema or COPD (GOLD Grades III or IV).
  3. Have smoked at least 87,600 cigarettes manufactured by Imperial Tobacco, RBH or JTI-MacDonald between January 1, 1950, and November 20, 1998.
  4. Must have been a Quebec resident at the time of diagnosis and at the time of death.

Validation of the diagnosis and its date:

  • On your behalf, we will first obtain information from the Quebec Cancer Registry or MED-ECHO concerning the diagnoses of the tobacco victim, including the diagnosis and its date.
  • If the information provided by these registries does not confirm the diagnosis, the Proactio team will inform you or you will receive a notice from the administrator.
  • In that case, proof of diagnosis will be required to demonstrate that you meet the criteria. We’ll help you and direct you to the right resources to obtain the relevant medical records.
