Important instructions to read before you start the registration

This form includes questions about the smoking-related illness and smoking history of the tobacco victim. In the event of the death of the tobacco victim, the form will also ask you questions regarding their estate.

Please note that some fields are mandatory in order to submit the form.

If you start the form but do not submit it, you will have to start filling in the information from the beginning. In other words, once you have started, you must submit the form for your answers to be recorded. After attempting to fill in this form, you will not be able to start it again for a period of 48 hours.

It is therefore important to have all the information on hand to fill in the form correctly.

Here is the information you will need before you start:

  • The date of the tobacco victim’s diagnosis, to the best of your knowledge;
  • The history of the tobacco victim’s smoking habits, including the brands of cigarettes smoked and their consumption;
  • If the tobacco victim has died and their heirs are known, information on each of the heirs, including:
    • Their date of birth;
    • Their email address;
    • Their telephone number;
    • Their postal address;
    • Their date of death and information relating to their estate, if applicable;
  • If the tobacco victim is deceased and their heirs are to be determined by law, information on each member of the tobacco victim’s family who may potentially inherit (spouse, children, grandchildren, siblings, parents, etc.), including:
    • Their date of birth;
    • Their email address;
    • Their telephone number;
    • Their postal address;
    • Their date of death and information relating to their estate, if applicable;

We ask that you submit your documents at the end of this form. It would therefore be preferable to have collected all the requested documents before starting to fill in the form.

Here are the documents you will need, depending on your situation:

  • If the tobacco victim is deceased:
  • Death certificate issued by the Directeur de l’état civil (Registrar of Civil Status) ;
  • Will search of the Barreau du Québec;
  • Probate search of the Chambre des Notaires du Québec;
  • If the tobacco victim died leaving testamentary dispositions:
    • The notarized will;
    • The private will (holograph or before witnesses) and minutes of probate by notary or judgment from the court; or
    • The marriage contract.
  • If the tobacco victim has died and their heirs are to be determined by law,
    • The declaration of inheritance signed before a notary; or
    • The documents establishing the link between the heir and the tobacco victim.
      For example, you will need to provide the following documents to prove the relationship with the tobacco victim:

      1. for his children, you will need to provide their birth certificates.
      2. for his or her married or civil union spouse, you will need to provide the marriage or civil union certificate.
      3. for his parents, you will need to provide the victim’s birth certificate or a copy of the death certificate.
      4. for his/her brothers or sisters, you must provide the victim’s birth certificate or a copy of the victim’s death certificate, as well as the brother’s or sister’s birth certificate.
      5. for his/her nephews or nieces, you must provide the same documents as for the victim’s brother or sister, as well as their birth certificate.
      6. for other class members, you must provide at least their birth certificate and contact us to find out what additional documents to provide.
  • If you are representing a living victim, you must provide the document authorizing you to act on their behalf, i.e.:
    • A power of attorney;
    • A protection mandate that was probated by the court; or
    • A judgment for the opening of tutorship for adults.

However, if you do not have everything to hand, you can submit them via our secure submission platform on our website. In order to submit documents via the secure submission system, you will need to provide your file number (CAS-12345-123ABC), which will remain the same. So, if you have answered all the questions but are missing one or two documents, it would be easier for you to submit the form and send us the documents as soon as you have them.
